Was reading an article in a Newspaper about computer repair shops ripping people off on simple repairs.

 

In particular one instance where someone took their Laptop or PC into repair and had some pictures downloaded by the repair agent and now being used for their store.

 

This person was female and i got really aggro when i heard this tech guy removed the pictures in the first place. Secondly she reported this to the police and they did nothing as they said you gave them rights to access your computer.

 

I contacted her and said Bullshit on the Police as you cannot remove data as that would be Theft of property, secondly to use them for business without your permission would be breach of copyright. As she took the pictures herself on a camera.

 

When i worked as a consultant i always thought that you can only remove data that impedes the start up of windows or its operation. Doing this either by Virus Scanner or through Hardware Software problems. But you cannot touch Personnel data.

 

So what is the rights of a person taking their PC or Laptop in for repair.

It totally depends upon the fine print of what is signed when a machine is handed over to a tech.

 

You get these all the time, very good reason why I'm thinking a majority of Atomicans either fix their own problems, find an Atomican who can fix it or extract drives and get a new system :)

 

What you describe is much more a privacy invasion if I'm reading it right but you need to first of all recognise, the data was not removed, it was copied, major difference.

 

Even if you have a PC refusing to boot you don't remove the code causing the problem, you disable it in startup.

 

People handing a pc/laptop/smartphone to a third party need to be very, very aware of what they are doing - my stepdaughter has learned this a couple of times.

 

Brave New World, with a lot of sheep in it likely to be shorn...

I've done a lot of data recovery and rebuilds for friends ... and friends of friends, all of whom have been quoted enormous sums of money by shifty people to fix something quite simple. When I recover data, I also show interested persons how to do it themselves.

But people really need to take some responsibility for their own data. I'm amazed how many people do not backed up ... ever. All my important data lives in the cloud, so I have no hesitation wiping the drive and starting afresh. Simple maintenance is all that's required and it's been made easy enough for anybody to do. if the device needs to go to a repairer, it can be wiped of data first.

It is true Nightowl, so long as the cloud doesn't rain :)

 

I do much the same but it amazes me how many people are still wary of cloud anything.

 

Data recovery I agree, usually no big deal, sometimes non trivial and that I do pass to the reputable experts.

Is a massive breech of privacy and is unauthorised use of the laptop owners images. However the laptop owner would probably have to initiate legal action themselves to get the store to remove those images.

Depends what the pictures are of.  If they're of the person then it's a privacy breach, case closed.  If it's something like an artsy sunset pic taken from a public place then you're kinda screwed.

 

The problem with outsourcing system/data recovery as such is the system's often not in a state where you can just pull private data off in a standalone type of way before sending the machine out.

 

But a business who takes pics and blatantly displays them like that... ultimately they're screwing their own reputation over and will probably eventually overstep the line with someone who doesn't take kindly to it and returns the favour with interest.

I don't trust anyone with my data. Even our internal IT department. They are professionals, but sometimes curiosity can get the better of people with the best intentions.

Seems like repair technicians work under a code of where they think they can do anything.

 

This person is photographer and its her hobby ,she had no idea they where stolen until after she saw a flyer from the shop.

Hmmm, let's weigh the options here ..... on one side, there's a) a possible loss of data, needing data that's sitting on another device, regular manual backup to cd, setting up your own remote server/drive and hoping you have the security right .... and mirrored of course, risk your data falling into the hands of unscrupulous persons through device loss or repair ...... opposed to the other option of b) using a reputable cloud service. A no brainer in my opinion.

.... and it just occurred to me whilst rereading this thread.... why is this directed at the female portion of the community ? Now that I think about it, I've had to recover data and scrape off all types of malware from devices owned mostly by male persons. In fact, one rendered his device totally inoperable, so used his partners instead, doing the same thing to hers !

You know this all goes back to the way some sections of the community that handle and deal with technology they buy. For instance some people buy Digital Cameras and they have no idea how to delete the photo's they have taken or even have them backed up. All they know is a software package tells you to plug in a usb cable and download to your PC or other device. But it does not tell you to delete the photo's to create more room on your MicroSD. " hello ,i cannot take any pictures on my camera it says a memory storage error" . Give me $50 and i will fix it.

 

Bottom line is it comes down to laziness in technology and how we deal with it ,this is why so many fall prey to unscrupulous dealers and Repair agents.

 

So how do we deal with it?

@codecreeper ... How do we deal with it ? Keep yourself informed ! People get ripped off with car repairs in exactly the same way. It's easy enough to avoid ... a) get to know what's under the bonnet ... b) alway get a second opinion ... and even a third if your senses are tingling.... and c) never leave your wallet and cell phone on the back seat. Works with everything really. Why do people know how to shop around for the best price on insurance, cars, bank loans and home appliances etc, but have no idea on repairs and maintenance ?

My concern is more that because it happened to a female friend of yours you are saying that the female community needs protecting.

 

Rubbish.  There are plenty of females out there knowledgable enough about computers and backups to not let this happen.  And plenty of men clueless enough that it could happen to them.

 

And that's leaving aside the older population of both men and women who are generally less knowledgable about IT as well.

 

Surely the question should be "how do we protect ALL CONSUMERS from this practice?"

I once repaired a friends computer, saved everything on their HDD and rebuilt the system.

Had a quick glance of the pictures to make sure all was there.

 

Saw a few XXX pics.

 

When I returned the PC, I told them all pics and personal stuff was saved.

His Wife says to me "What did you think of the home videos *wink,wink* "

The Husband asked if I saved a copy for myself.

I swear there was a heat wave as I started to sweat....

She just smiled.

 

I still see them. But.

I still can't look at her and not think of the pics..

Can't help but think that was an invitation Triggerhappy ;)

 

If I had to take my lappy somewhere it would just be a hassle to do As for anyone seeing what's on my machine ...

well that would be a very short and boring exercise. My beef would be ..." could I trust the person to not put something

in my works that wasn't supposed to be there ? " ... This would bug me more than anything else as I'm very much a noob.

... I'm a noob but I'm a suspicious untrusting (<<spellcheck doesn't like this word ) noob.

I suppose when you look at it ,its a bit like all those pictures stolen from Hacked accounts in Hollywood. Then the celebs jump up and down over pictures being released on the internet.

 

Anyhow it was not a friend of mine just a situation i read about in Facebook ,it kind of annoyed me a bit.

If the store is using the photos on their flyers, isn't this a copyright issue? If she personally took those photos, then she owns the copyright and should seek legal advice on how to commence proceedings, provided that she can either a) demonstrate a loss or b) demonstrate that he profited from using the images without her authorisation.

 

At the very least, she can issue him with a cease and desist to have him withdraw the flyers from circulation and remove the copyrighted images.

 

But I'm not a lawyer, so please take anything I say with a grain of salt.

This is why I only ever repair my own machines.  Or ask my brother to do it.

 

However, I still don't trust the cloud.  I don't trust any cloud provider's security processes.
