It's got nothing to do with the council, that bit's to do with the State/Territory government. Perhaps it depends on state, or specifics of what's wrong. Either way, a friendly phone call to the council will get you the answer to this. Rob. I'm with Robzy on this one. It's not just about procedure, legal rights, and limits of your position. What about Morale obligation? I know that if I were a landlord, I would be stocked to have tenants who were providing information about what's going on. Not just to the estate agents, but to the council as well. Even if this guy is in the right, the tenants are wanting to do what's right by the landlord.

An interesting one. I don't think it unreasonable that you contact council to check, if you were my tenant I'd be more than happy if you did. Could well see the same happeneing here as I know the fence at the back of our garden is located ~30cm into our property (ie the property is a little smaller within the fence than it should be). It is a historical quirk from when the houses were built and they had no dividing fence (they decided they'd share the back gardens). To divide the properties they planted trees/bushes on the line of the property so that when one of the historic owners of our house bought a dog and decided to erect a fence they built the fence slightly inside the property boundary so that the, then fully grown, bushes didn't get chopped down. Not really a problem on our side as the 1130sqm left within the fence is more than enough but it does mean that a new owner could easily do what has happened to you with full rights. You really need to know exactly where the actual property boundary is, and council would have these details.

I see this come up time and time again, so I just thought I'd set this straight. If you are a renter you have just as much right to take action as the owner of the property. You're the one who actually lives on the property, you are the occupant in terms of the law even if you don't actually own the place. In fact in civil damage claims and disputes the owner of the property has no title to sue, it's the occupant/tenant who needs to bring the action.
