It should have been prosecuted, but jail time was over the top. A financial and community based sentence would have been better, particularly one where he would visit schools in his area to warn kids about what they say on the internet. Such a sentence would drive home the message to himself, and help prevent future cases.

 

I've got no issue with the 'right' to 'freedom of speech' being overruled by other, more important rights.

Yes. I've never been racially villified. Sexually harrassed maybe, by a range of ethnicities that doesn't exclude Anglo-Saxon backgrounds, but that's a whole different ball park.

 

When you speak to such a huge audience as I do, especially those who are at a disadvantage or are highly ignorant, you see prominent ethnicities and note different cultural tendencies in personality. So you use a different approach when dealing with them than you might normally use.

 

I think caucasian people primarily have it better than other demographics. But a person's character can be changed by individual choice of environment, that is based on what they surround theirselves in and whether they choose to act on opportunities presented to them.

 

People are capable of making better choices. This person made a terribly stupid choice.

 

Jail time for that long a period seems extreme and unnecessary.

He was sent to gaol for tweeting stuff like "LOL [laugh out loud]. Fuck Muamba. He's dead!!!". I bet a fair portion of the internet would be locked up if that was applied everywhere.

 

Sounds like a huge waste of state resources... but the pc crowd have always been good at that.

 

If he was encouraging violence (or trying to organise it), then gaol would be a fair call.... being a douchebag shouldn't carry a gaol sentence imo. Looks like the "right to not be offended" is still being enshrined into law.

I think the jail time was a bit too much, but yes he should have been prosecuted.

 

If this policy got applied to the rest of the internet, the entirity of /b/ would be locked up for years :P

K after reading what he wrote this is a huge overreaction by the PC nazis. Sure the guy is obviously a dropkick but given the comparative sentencing for some people who commit violent crimes as opposed to merely showing the world how retarded they are then this reaction by the courts is way OP. Name and shame would have been a more appropriate approach and probably would have got a better result.

Glad to see an idiot caught out for saying something incredibly dumb online, it happens far too often.

I agree jail seems excessive, but community service seems appropriate.

 

However, it does leave me worried how long until other online activities begin to be "policed" until you have to be careful what you say online too. I believe in the right to say or think anything you like, but I also believe in respect for all individuals. I would certainly feel threatened if I felt I could no longer discuss certain topics online, without repercussion.

 

Example: there are plenty of corners of the internet out there that will teach you how to make a bomb (that works) or grow decent dope (illegal) or brute force a password (probably illegal) but if I read it, or contribute to the information, how long until they will try to hold me accountable?

Racist comments are probably just the beginning.

IMO should not have been prosecuted 2 main reasons I feel that we should be free to express our selves however we see fit and there is a social consequence of bad behavior no one will want to hear him talk.

Secondly I don't like giving too many personal freedom laws because the line can become blurry as to what is enforced secondly laws don't often get removed once something like this becomes precedent so they can be exploited or expanded on further down the line.

I didn't say poor white people, i pointed out that white people get more racism convictions for smaller things.

 

 

If you dont think thats fucked up compared to tweet boys case then its your mind thats warped

It doesn't really matter how fucked up I think that case is, it is stupid to make any assumptions based on exactly two examples. If you think whites are hard done by prove it to be so.

I'm at work at the moment and will definitely expand on this later, but this seems dangerously close to thought police.

 

Think and say what ever you like, but so long as we say you can.

Replying to my own post, there's a first for everything.

 

So here's the thing, and I've long maintained this, we either have free speech, or we don't.

 

Personally, I'm not for any system that allows people to say what ever they like with complete impunity. Words have power, words win elections, destroy reputations, spark violence, or create peace. So if words can result in things happening then we have to use our words wisely and take responsibility for them.

 

But words also articulate our thoughts, our feelings, our opinions. We certainly have a right in this society to those thoughts, feelings, and opinions without the fear of prosecution. So where do we find the middle ground?

 

The current relationship between classic media and the internet is something we're only just trying to get a handle on, and it's constantly darting off and going in weird directions. The internet isn't the wild west of ideas and words it once was where you could say what ever the fuck you wanted with anonymity and get away with it. Nope, you're now much more accountable for what you say. God forbid if you have any public profile because the media will jump all over you in a heat beat if you say the wrong thing.

 

A lot of the time when this happens, I find myself asking "Really? is this really news? some idiot most of us don't care about just showed the world what a douche bag they are, big fucking deal." But to face gaol time for speaking your mind? I find it absurd! Can't we just harden the fuck up a little and say "Wow, what a fuck wit!" and leave it at that? Do we really have to gaol people for airing opinions that we collectively dislike? Where do we draw the line at what is violence inciting hate speech and some guy just being a tosser? At what point does airing other ideas and opinions become a crime as well?

 

This is a slippery slope to be sure. Sure, have laws that make a person liable if their words have actual, provable damaging consequences. But to gaol someone just because they're a fuck head? Nup, the pendulum has swung too far on political correctness.

 

What hurts me the most about political correctness is that it merely tries to hide the face of prejudice. Cos I gotta tell yu, when I look around I see racism and sexism still well alive and kicking to the point of still institutionalised. But gods fucking forbid you remind people of that.

He's not saying whites are hard done by, even a child could figure that out. But i suppose you are so intent on seeing what you want to see that you're probably not even reading what he's saying. He's saying that when it comes to racism, there is a double standard.

in which case there are precedents for mitigation given his state of intoxication

 

drive a car pissed and you are arrested

 

hit a pedestrian and you aren't as culpable as if you were sober

 

insult some soccer player (whatever he said) and you are jailed

 

more details required - if he said "die you black c..t" he is not going to get away with it regardless of disinhibition, because the politically correct response is to set a "correct" example

I think so too.

 

What good will be done by sending someone like that to prison ? A warning to others perhaps, to keep there natural thoughts in check, and only display them in like-minded company, and definitely not on the interwebs.
