Any Lawyers in the house?

 

Hi All, I'm coming here for some advice, I will contact a lawyer about this but i was hoping someone may be able to shed some light on my situation. I have co-ownership of a home (50/50) with my ex partner. I currently reside in the house and have done so since she left me last Feb(2012). She stayed on in the home (separate rooms) till approx early April 2012. I am in WA. I have been paying 100% of the loan repayments, rates, insurance and maintenance costs for the home. The loan we have is currently locked in to a fixed term interest rate till the end of this year(2013), so we were going to wait till then to sort out the property to save on exit fee's. I am hoping to buy her out at that stage. She is under the impression that she has no obligation to pay me back any of the mortgage payments as she considers me paying it is "rent" for her. I never agreed to this and was wondering if this is true? I wanted to deduct the money she has not contributed to the home off the final value if i decide to buy her out. Any help would be great, I was hoping to end this sooner than Dec this year just to get her out of my financial life! I feel like i need to tip toe around her and be "nice" until it is all sorted and have had enough of it. I feel like i can't move on with my life till this has been resolved.

 

I have sorta been where you are now dude, and let me say, it's not easy. I had a defacto partner back almost 20 years ago, we had been together for 6 years and were planning to get married not too long after that. Then, just about 2 years later, we broke up. That would've been that, however, her father who was a solicitor, probably advised her to proceed with litigation. At that time I owned 2 properties in Sanctuary Cove, Queensland, assessed at 600-700k AUD each. To put it simply, the court ORDERED me to "give" one of those properties to her as compensation for the time she and I were together, even though she didn't contribute one sent to either of those 2 properties and I had contributed financially (loans to her parents) to her family.

 

The problem here is that, even though she wasn't my wife, and we hadn't spent decades of life together as husband and wife, at the time(circa 2001), they still calculated a partner's contribution to the relationship as what they would do a wife (bear in mind that we didn't have any kids either). If we had kids, it would've been far worse. Its been a decade and a half since then, and I haven't kept up to date with the law but I am still assuming that its the same. If it is, then, what I have mentioned above, could happen. I suggest seeking legal advice of your own. Every situation is different and has to be handled that way. All the best mate.

Oooo too harsh you be ! People were used to post all sorts of wonderful life issues here . I recall a guy who seriously wanted to know whether he should throw a raw piece of meat at the lady who had won his heart.

Sounds like 'taking the Lord's name in vein' to me (not that anyone can define what 'in vein' actualy means), so whoever tries that is likely to get death threats. Or actually dead.

after my post i couldn't pass up on the idea of salmon rosti for brunch

 

and i made a truly awesome batch which were pretty authentic - simply grated raw potato with onion, garlic and salt and pepper, squeezed the bejesus out of them (well, most of the unholy water anyway) in a clean tea towel, and then added a bit of melted olive grove (ms 22 spits at butter in cooking), and then shallow fried them

 

they were marvellous with smoked salmon, avocado, lemon juice and cream cheese :)

 

sacrilicious !

This morning for breakfast I had four weet-bix plus the left-over crumbs from the empty packet, microwaved for two minutes. Then honey drizzled of top and then a banana on top. For lunch I'm thinking a ham-and-cheese toastie with the homemade bread my wife makes.
